1. Acceptance of Terms
By downloading or using Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd), you agree to this Privacy Policy. If you do not agree, please uninstall or stop using the app immediately.
2. Permission-Based Information We Collect
We only request access to information that is required to verify identity, evaluate credit eligibility, and ensure secure functioning of the app.
2.1 Personal Identification Information
We collect data such as your full name, gender, date of birth, address, email, and phone number. PAN or Aadhaar details may also be requested for identity authentication.
This data is used for account setup, fraud prevention, and compliance checks.
It is encrypted and transmitted only to https://api.valendrixfin.com/. Once your loan is successfully disbursed, your personal information and transaction records will be kept for at least 5 years, as required by the Reserve Bank of India (RBI), for RBI anti-money laundering investigations and regulatory audits.
2.2 Financial SMS Messages
With your permission, we access only SMS messages related to financial activity (bank deposits/withdrawals, salary credits, repayment confirmations, and overdue reminders) received within the last 180 days.
We do not read personal messages such as private conversations or OTPs unrelated to financial assessment.
These SMS insights support credit evaluation and risk control and are erased after a lending decision is completed.

2.3 Device Information
We collect limited technical identifiers such as device model, operating system version, network type, IMEI, and advertising ID.
This information helps ensure security, detect fraud, prevent duplicate accounts, and optimize app performance.
It is encrypted, transmitted only to https://api.valendrixfin.com/, and deleted once onboarding or credit assessment ends—unless regulations require longer storage.
2.4 Camera Access
We access your camera only when you choose to take photos of ID documents or selfies for KYC verification.
Images are used exclusively for identity validation and deleted after verification or credit decision.

2.5 Installed App
We will collect information about the applications installed on your device, including the app's package name, version information, and installation and update dates. The purpose of collecting this information is to assess your financial behavior, verify the integrity of your device, and prevent fraud.

2.6 User Behavior Data
We may gather anonymized interaction data, including but not limited to:
User tap and touch interactions
App usage time and session length
In-app navigation and flow behavior

This data is used to identify abnormal usage patterns, enhance user experience design, and improve overall system stability and performance.

We do not collect contact lists, call logs, calendar data, or any information outside of the items listed above.
3. How We Use Your Data
Your data is processed strictly for purposes such as:

Preventing fraudulent or risky transactions
Improving user experience and resolving technical issues
Meeting regulatory and compliance requirements
Data will never be used for unauthorized or hidden purposes.
4. Data Sharing Policy

With licensed financial institution Nishtha Leasing Private Limited (NBFC) and service partners for credit checks, loan disbursements, or repayments;

6. Your Rights and Choices
You may:
View or update your personal details inside the app
Request deletion of data through the “Delete My Data” option (subject to legal retention rules)
Withdraw your permission by uninstalling the app (future data will no longer be collected)
We will support requests in accordance with legal requirements.
7. Data Retention
We retain data only as long as needed:
Information for active users is kept during the service relationship and the additional period legally required for compliance
Information for rejected or incomplete applications is deleted within 90 days
Records required for disputes or audits remain until mandatory regulatory timelines expire and are then destroyed
Once a retention period ends, information is permanently removed.
8.India NBFC Customer Consent Framework
Our App follow the Account Aggregator (AA) framework,which is a new type of RBI-regulated Non-Banking Financial Company (NBFC) that acts as a neutral and "data-blind" intermediary . only job of AA framework is to facilitate the flow of information. It cannot see, store, or use your data; It simply carry it from one place to another based on your explicit command .
Our App AA framework has four key participants:
You (The Customer/Data Principal): You are the owner of your data and are in the driver's seat .
Financial Information Provider (FIP): NBFC (Nishtha Leasing Pvt Ltd) is the institution that holds your data.
Financial Information User (FIU): VALENDRIX FINTECH PRIVATE LIMITED is the institution that requests your data to provide you a loan service from NBFC (Nishtha Leasing Pvt Ltd).
Account Aggregator (AA): The licensed NBFC (Nishtha Leasing Pvt Ltd) that securely carries your data between the FIP and the FIU, based on your consent .
Users can approve the request by specifying exact details on a digital interface in our App provided by AA . You can choose to share only the specific information needed.You see exactly which institution is requesting the data and for what purpose.Users can decide the duration of data access.Users can use their ability to revoke data,users can cancel their consent at any time, instantly cutting off their data access via our customer service.Once users give consent, a tamper-proof digital consent artefact is created. This serves as a digital record of your permission, creating an audit trail and ensuring accountability for everyone involved.
9.Types of Audits and Rights
Following the NBFC Framework,there will be audits for lending services from our App.
Statutory Audit: The Cornerstone of Compliance
NBFC (Nishtha Leasing Pvt Ltd) must undergo a statutory audit annually. The auditor, a Chartered Accountant firm appointed by the company's Board, verifies the financial statements and ensures compliance with the RBI Act and Companies Act . The RBI has prescribed strict eligibility criteria for these auditors based on the NBFC's asset size, including minimum partners, experience, and professional qualifications .
Fraud-Related Audit: NBFC (Nishtha Leasing Pvt Ltd) has right to investigate borrowers from our App.
Right to Audit Borrowers: If NBFC (Nishtha Leasing Pvt Ltd) suspects fraud in a loan account, it is now mandatory to refer the matter to an internal or external auditor for investigation. Critically, NBFC (Nishtha Leasing Pvt Ltd) is required to incorporate specific clauses in their loan agreements that grant them this right to conduct audits at the lender's behest .
Audit of Third-Party Service Providers: The RBI has widened its supervisory gaze to include Loan Service Providers (LSPs) —VALENDRIX FINTECH PRIVATE LIMITED that partner with NBFC (Nishtha Leasing Pvt Ltd) for customer acquisition, underwriting, and loan management .
10.Data Localization & Protection Statement
10.1. Sovereign Data Storage
NBFC (Nishtha Leasing Pvt Ltd) hereby declares and ensures that all customer data, financial information, transaction records, and personal identifiers processed by the company are stored and maintained exclusively on servers and cloud infrastructure physically located within the geographical boundaries of India . We do not store, replicate, or backup such data in any jurisdiction outside India unless explicitly mandated or permitted by a specific exemption from the Reserve Bank of India (RBI) .
10.2. Regulatory Compliance & Cross-Border Transfer
In compliance with the RBI Master Directions and the Digital Personal Data Protection Act (DPDPA), 2023, cross-border transfer of sensitive financial data is strictly prohibited . Where access to data is required by the company or its service providers for operational support, such access is restricted to remote viewing only, ensuring that the data remains domiciled in India and does not leave Indian territory . No foreign replication of core banking, payment, or KYC data is permitted .
10.3. Third-Party Vendor (LSP) Accountability
The company remains fully responsible for the confidentiality, integrity, and availability of customer data, even when services are outsourced to Loan Service Providers (LSPs), NBFC (Nishtha Leasing Pvt Ltd) fintech partner VALENDRIX FINTECH PRIVATE LIMITED, or IT vendors . All vendors and data processors are bound by strict contractual obligations mandating:
India-only storage of data .
Implementation of need-to-know access controls and non-co-mingling of data in multi-tenant environments .
Granting of audit and inspection rights to the NBFC (Nishtha Leasing Pvt Ltd) and the RBI to verify compliance .
Immediate incident reporting and cooperation during regulatory inspections .
10.4. Customer Consent & Data Usage
We adhere to the principles of granular consent and purpose limitation as outlined in the RBI Digital Lending Guidelines and the DPDPA . Customer data is:
Collected only with explicit, informed, and separate consent (not bundled with other terms) .
Used strictly for the purpose for which consent was granted (e.g., credit assessment, loan servicing) .
Subject to the customer's right to access, correct, and withdraw consent, leading to the secure deletion of data where applicable and permissible by law .
10.5. Data Security & Sovereignty Infrastructure
To ensure compliance, the company utilizes, where applicable, secure domestic infrastructure such as the Indian Financial Services (IFS) Cloud or other RBI-compliant local data centers . We implement robust security safeguards including encryption, multi-factor authentication, and real-time fraud monitoring to protect data in transit and at rest, in alignment with RBI's cybersecurity frameworks .

Terms of Use and Loan Application Conditions
Welcome to Sunny Rupee, a digital lending platform operated by NBFC Nishtha Leasing Pvt Ltd. The platform enables users to explore a variety of financial products, including personal loans, business loans and other specialized financing solutions. Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) also provides technology-driven services that support instalment-based purchases, customer onboarding, credit origination and other associated processes for its partnered financial institutions (“Financiers”).
As a Lending Service Provider (LSP), Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) carries out outsourcing functions for its Financiers, which may include customer acquisition, assessment, monitoring, and loan collection activities, as permitted under the respective service agreements. The platform’s objective is to offer a fast, convenient and technology-enabled credit experience to customers across India.
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) acts only as a technology platform and Lending Service Provider (LSP) facilitating loan applications for regulated financial institutions. All loans available through the platform are sanctioned and disbursed solely by Banks or NBFCs registered with the Reserve Bank of India. Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) does not itself lend money unless specifically stated.
The identity of the lending institution(Banks or NBFCs), interest rate, Annual Percentage Rate (APR), loan tenure, processing fees and all applicable charges will be disclosed to the borrower through the Key Fact Statement (KFS) before acceptance of the loan.
All recovery and collection practices will follow the Fair Practices Code issued by the Reserve Bank of India and applicable laws. No coercive or unethical recovery practices will be used.
By choosing to access or use Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd), you acknowledge that you have read, understood and accepted these Terms of Use (“ToU”) as well as the associated Privacy Policy. Your continued use of the platform implies your agreement to comply with all conditions, notices and obligations stated herein. Sunny Rupee may revise or update these terms at any time, without prior notice.
1. Conditions for Loan Application
1.1 Acceptance of charges and disclosures
You confirm that you have reviewed and accepted the Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) applicable charges, fees, commissions and the key fact statement provided by the Financier. Taxes, including GST, may be levied as applicable.
1.2 No additional commitments
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) and its representatives will not offer gifts, discounts or benefits beyond what is expressly stated in the product information.
1.3 Incomplete applications
Applications of Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) that are incomplete, incorrect or illegible may not be processed. Any delay arising from such issues will be solely the customer’s responsibility.
1.4 Approval not guaranteed
Submitting an application does not ensure approval. Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) may approve, reduce or reject the loan request at its absolute discretion.
1.5 Information sharing by Financier
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) may share your information—including personal details, loan data, repayment behaviour, defaults or security details—with authorised agencies such as credit bureaus, regulators, financial institutions, affiliates, rating agencies or service partners for verification, credit assessment or related purposes. Such information may also be used for risk evaluation or monitoring.
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) Customer data will only be collected with explicit consent and will be used strictly for credit assessment, regulatory compliance and service improvement. Sunny Rupee will not access mobile contacts, media files or other personal data unless required and permitted by law.
1.6 Retention of documents
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) may retain your application form, documents or photographs regardless of the decision taken on the loan.
1.7 Delayed payment consequences
In case of overdue payments, applicable penal charges may be imposed in addition to any other rights Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) may exercise. Additional documents may be required to complete ongoing assessment.
1.8 Truthfulness of information
You affirm that all information provided is genuine, accurate and complete.
1.9 Use of loan funds
You agree to use the loan amount strictly for the stated purpose and not for speculative, illegal or restricted activities.
1.10 Politically Exposed Person declaration
You confirm that you are not a Politically Exposed Person (PEP). Should your status change, you must promptly inform Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd). Additional due-diligence procedures may apply to PEP accounts.
2. Customer Authorisations and Declarations
You authorize Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) to share your application data and supporting documents with its affiliates, partners, credit bureaus, service providers or regulatory bodies for verification and risk assessment.
You acknowledge that you have read and understood all conditions related to the loan.
You confirm that you are an Indian citizen.
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) is not responsible for delivery timelines or the quality of any product purchased using the loan.
Borrowers fo Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) will be provided a cooling-off / look-up period, during which they may exit the loan by paying the principal amount and proportionate charges without any penalty, as specified in the Key Fact Statement.
You agree that, in the event of loan cancellation, any applicable annualized charges on the outstanding amount must still be borne by you. Processing fees are non-refundable except during an applicable cooling-off period.
Any digital or electronic sanction letter received is preliminary and subject to final approval upon submission of all required documents.
Loan documents such as the welcome letter, key fact statement and repayment details will be sent to your registered mobile or email, or made accessible through the Sunny Rupee mobile application.
If any clarification is required regarding statements or records, you must notify Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd); however, you may not delay or withhold payment obligations under any circumstance.
3. Repayment Obligations
You agree to repay all dues through NACH mandates, bank transfers or other modes accepted by Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd). You must ensure adequate balance is available in the account linked to the repayment mandate.
You will not close, alter or instruct your bank to block the repayment mandate without settling all outstanding amounts.
You authorize Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) to access your credit score or obtain credit information from approved bureaus.
By registering on Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd), you consent to receive service related communications through calls, SMS, email or other electronic means in accordance with applicable telecom regulations.
In case of conflict between these terms and specific loan documents, the loan documents shall prevail.
4. Responsibilities Relating to Platform Use
You must maintain complete confidentiality of your login credentials and prevent unauthorized access.
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) does not guarantee uninterrupted availability, accuracy, reliability or suitability of any content or services offered on the platform.
Any downloaded, printed or copied material is at your own risk; Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) is not liable for altered or corrupted content.
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) shall not be responsible for loss, damage or failure arising from system issues, delays, service interruptions or inaccuracies.
Services may be suspended without prior notice if security concerns arise or as deemed necessary by Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd).
5. Changes to Platform, Content or Policy
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) may revise, remove or reorganize any part of the platform, including its design, content or functionality, without prior notice. Users are responsible for keeping themselves updated with any changes.
Although reasonable efforts are taken to ensure accuracy of information, Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) does not guarantee completeness or correctness of any data.
6. Non-Compliance
If Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) suspects or identifies misuse or violation of these terms, it may take actions such as:
Issuing warnings
Temporarily or permanently restricting access
Blocking access based on device or IP
Requesting service providers to block access
Initiating legal proceedings for recovery or damages
Suspending or deleting your account
You agree to indemnify Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) and its affiliates against any claims arising from your misuse of the platform.
7. External Links
Links to external sites may be available for user convenience. Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) does not endorse, control or take responsibility for the content, policies or services of such third-party sites.
8. Governing Law
All activities, terms and services provided under Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) shall be governed by the laws of India. These terms constitute an electronic record under the Information Technology Act, 2000.
9. Limitation of Liability
Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd), its affiliates, directors or employees shall not be liable for any loss, damage or expense—direct or indirect—arising from:
Use of the platform
Inaccuracy or unavailability of services
Technical errors, delays, interruptions or system failures
Viruses or harmful components
Reliance on any data or statement displayed on the platform
You may contact Sunny Rupee’s customer support for discrepancies in records or statements.
2.1 Grievance Redressal
Customers may contact Sunny Rupee(operated by NBFC Nishtha Leasing Pvt Ltd) grievance officer for any complaints or concerns relating to the platform or services. If the complaint remains unresolved, the customer may escalate the matter to the concerned regulated lender or through the Complaint Management System (CMS) of the Reserve Bank of India.

Refund Policy
This Refund Policy explains when Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) refunds may be issued for payments made via the App or website channels. This Policy is subject to applicable laws, the loan agreement and the operational rules of payment gateways and banks.
Refund Eligibility. Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) Refunds may be considered only in the following circumstances: (a) a technical error on the App or payment gateway resulted in an incorrect deduction; (b) duplicate payments were made for the same transaction; or (c) services were not rendered due to system failure or administrative error attributable to the Company. Refunds will not be issued for amounts legitimately applied to loan disbursal or repayment of outstanding dues.
Non-Refundable Items. Processing fees legitimately charged and retained under the loan agreement are generally non-refundable unless a technical error is proven. Loan repayments and amounts applied to outstanding dues are not eligible for refund. Statutory taxes that are non-reversible under law may not be refundable.
Refund Request Procedure. To request a refund, submit a written request via the App (Help → Transactions → Request Refund) or by email to Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) Grievance Email within seven (1) days of the transaction date, providing transaction details, proof of payment and a clear explanation. The Company may require additional documentation. Requests received after seven (7) days may be considered at the Company’s discretion.
Assessment, Approval and Timeline. Upon receipt of a valid request, Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) will investigate with payment gateway partners and banks. If approved, refunds will be processed to the original payment method within seven (7) to ten (10) business days. Payment gateway or bank processing times may extend this period; the Company will notify the customer of any expected delay.
Coordination with Payment Gateways and Banks. Refunds are subject to the operational rules and timelines of payment gateways and banks. Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) will coordinate with partners to expedite approved refunds.
Statutory Retention and Legal Constraints. Certain financial records, KYC documents and transaction data are retained for five (5) to ten (10) years in compliance with RBI Master Directions, PMLA, the Income Tax Act and other laws. Immediate deletion or reversal of certain records may not be possible even where a refund is approved.
Dispute Resolution. If dissatisfied with the refund outcome, escalate to the Grievance Officer or pursue legal remedies under applicable law. Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) will provide escalation details in its response.

Cancellation Policy
This Cancellation Policy sets out the terms under which loan applications or services initiated via the Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) may be cancelled and the consequences of such cancellation.
Cancellation Before Disbursal. Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) Applicants may request cancellation of their loan application prior to disbursal by submitting a cancellation request via the App (Help → Transactions → Cancel Application) or by contacting customer support. Provide the application reference number and identity details. Cancellation requests accepted prior to disbursal will be processed in accordance with this Policy.
Cancellation After Disbursal. Once a loan from Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) has been disbursed, cancellation is not permitted. Repayment, prepayment or foreclosure options (if any) are governed by the loan agreement.
Refund on Cancellation. If cancellation is approved before disbursal, refundable amounts (if any) will be processed after deducting applicable charges, including legitimate processing fees or administrative costs as per the loan agreement. Refunds will be processed to the original payment method within seven (7) to ten (10) business days of approval.
Statutory Retention of Records. Certain data and documents, including KYC and transaction records, are retained for five (5) to ten (10) years in compliance with RBI Master Directions, PMLA and the Income Tax Act. These records cannot be deleted immediately upon cancellation.
Procedure and Documentation. To request cancellation, submit a written request via the Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) or email to Grievance Email with the application reference number and supporting identity documents. Sunny Rupee (operated by NBFC Nishtha Leasing Pvt Ltd) may require additional verification.
Governing Law and Jurisdiction. This Cancellation Policy is governed by the laws of India and disputes are subject to Indian courts.
